Allocation of land plots

In accordance with paragraph 1 of Article 39.6 of the Land Code of the Russian Federation, the lease of land owned by the state or municipal property at auction is held in the form of an auction.

The contract of lease of land owned by the state or municipal property, is without tender in the case of (paragraph 2 of Article 39.6 of the Land Code of the Russian Federation):

  • land to legal entities in accordance with the order of the highest official of a subject of the Russian Federation to host social and cultural and household purpose, the implementation of large investment projects subject to compliance with these facilities and investment projects the criteria laid down by the laws of the Russian Federation;
  • land for the fulfillment of the international obligations of the Russian Federation, as well as legal entities for placing objects designed to provide electricity, heat, gas and water supply, sanitation, communications, pipelines, objects of federal, regional or local importance;
  • land, formed from land owned by the state or municipal property, including the provision for the integrated development of the territory, the person with whom he had entered into a lease of such land (Article 46.4 of the Town Planning Code of the Russian Federation..);
  • the land on which there are objects of unfinished construction, once for their completion to the owners of assets under construction in the cases provided for in paragraph 5 of Article 39.6 of the Land Code of the Russian Federation);
  • land, formed within the boundaries of built-up area, a person with whom a contract for the development of built-up area (Article 46.2 of the Town Planning Code of the Russian Federation..);
  • land for the development of land for housing construction in economy class or for the integrated development of the territory for the construction of economy-class housing legal person who has concluded an agreement on the development of land for the construction of economy-class housing or the agreement on the integrated development of land for the construction of economy-class housing (Article 46.5, 46.6 of the Town Planning Code of the Russian Federation);
  • land required for the implementation of the activities provided by the concession agreement, the person with whom signed a concession agreement (Federal Law 21.07.2005 N ° 115-FZ "On Concession Agreements);

Article 39.3. Russian Federation Land Code establishes the cases of sale of land owned by the state or municipal property, the auction without bidding.

Sale of land in state or municipal property, carried out to the highest bidder.

Without tendering sale is carried out:

  • land, formed from land granted in the rent for the complex development of the territory, the person to whom, in accordance with the Urban Planning Code of the Russian Federation signed an agreement on the integrated development of the territory
  • land on which there are buildings, owners of buildings, structures or premises in them.

Plot of land, located in state or municipal property is provided in the property free of charge on the basis of the authorized body of the decision in the case of land, formed within the boundaries of built-up areas for which a contract of its development, the person who has signed the treaty (Article 39.5 of the Land Code of Russian Federation).
